The DBA Act
Prove your self-employment status
Applicable to self-employed professionals (ZZP’ers) in the Netherlands 🇳🇱
Self-employed professionals without staff
As a self-employed professional without staff (ZZP’er) you’ve likely noticed the recent developments concerning self-employment. The government has introduced new plans, though the rules aren’t always crystal clear.
However, the tone is shifting. Freelancers are once again being recognised and respected as vital to the economy. The starting point is that freelancing is possible, provided it is properly regulated.
At the same time, the Tax Authority is enforcing stricter checks against false self-employment.
How do you make sure you comply with the rules?
Prove your self-employment status
Freelancers (ZZP’ers) are often hired as a flexible layer by clients to provide flexibility and scalability for a business or project. The government has implemented the DBA Act to prevent fraudulent contracting and sham self-employment.
To comply with the DBA Act:
Both freelancers and clients must structure their working relationship in such a way that it doesn’t qualify as employment under Dutch law.
The difficulty is that the criteria don’t stand alone, it’s about the specific situation and the full picture.
Your legal business structure doesn't matter. The focus is on the fact that you are self-employed without staff.
I’ll guide you through the DBA Act, explain how to comply with it, and share tips and useful links, along with an explanation on how to use them.
